The term "equivalence" of a solution is understood in particular: demonstrating that the offered solution has at least the same or better - described in a given standard - technical parameters and functional quality features, which refer to the functional values of the subject of the contract, specific to the material, component, product used, such as: functionality, efficiency, comfort of use, safety, comfort of use, and features describing the physical characteristics of the object order. W każdym przypadku, gdy Zamawiający opisuje przedmiot umowy poprzez wskazanie znaków towarowych lub poprzez odniesienie do norm, europejskich ocen technicznych, aprobat, specyfikacji technicznych i/lub systemów, referencji technicznych, Zamawiający dopuszcza rozwiązania równoważne z opisanymi.
Równoważne rozwiązania oferowane przez Wykonawcę będą miały co najmniej takie same lub lepsze parametry techniczne i funkcjonalne, co najmniej w zakresie opisanym w każdej z norm i nie będą obniżały standardów ustalonych przez Zamawiającego.
Przez pojęcie „równoważność" rozwiązania rozumie się w szczególności: wykazanie, że oferowane rozwiązanie posiada co najmniej takie same lub lepsze - opisane w danej normie - parametry techniczne i cechy jakości funkcjonalnej, które odnoszą się do wartości funkcjonalnych przedmiotu zamówienia, właściwych dla materiału, komponentu, użytego produktu, takich jak: funkcjonalność, wydajność, komfort obsługi, bezpieczeństwo, komfort użytkowania, oraz cechy opisujące cechy fizyczne przedmiotu zamówienia. Wykonawca, który powołuje się na rozwiązania równoważne, zobowiązany jest wykazać, że oferowane przez niego dostawy spełniają wymagania określone przez Zamawiającego.

In each case where the Contracting Authority describes the subject of the contract by indicating trademarks or by referring to standards, European technical assessments, approvals, technical specifications and/or systems, technical references, the Ordering Party allows solutions equivalent to those described.
Equivalent solutions offered by the Contractor will have at least the same or better technical and functional parameters, at least to the extent described in each of the standards and will not lower the standards set by the Ordering Party.
The term "equivalence" of a solution is understood in particular: demonstrating that the offered solution has at least the same or better - described in a given standard - technical parameters and functional quality features, which refer to the functional values of the subject of the contract, specific to the material, component, product used, such as: functionality, efficiency, comfort of use, safety, comfort of use, and features describing the physical characteristics of the object order. The Contractor who refers to equivalent solutions is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Ordering Party.
