Conditions 1. The Ordering Party requires that he has full rights to use the license and software installed in the devices. 2. The Ordering Party requires that the delivered devices, as well as their equipment and mounting accessories, come from the official distribution channel of the device manufacturer for the Polish market. 3. The Ordering Party requires the delivered equipment to be registered with Rafineria Gdańska Sp. Z o.o. . or a parent unit in order to have full license and warranty rights 4. The Ordering Party requires that all delivered devices have features / attributes of their legality, i.e. the manufacturer, model and serial number of the device 5. The Ordering Party requires the Contractor to provide the serial numbers of the devices before the delivery (on the day of delivery at the latest) in order to verify their source with the manufacturer. In the event of negative verification, the Ordering Party may refuse to accept the devices. The bidder submits the offer only through the Logintrade Purchasing Platform. Along with the offer, it is absolutely necessary to confirm the requirements set out in the content of the request for proposal and compliance with LOTOS standards. II. In connection with the prohibitions set out in the sanctions regulations issued in connection with the aggression against Ukraine, in particular: - Council Regulation (EU) No. 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (OJ L No. 229, p. 1, as amended) , - Council Regulation (EC) No. 765/2006 of 18 May 2006 concerning restrictive measures in view of the situation in Belarus and Belarus's participation in Russia's aggression against Ukraine (OJ L No. 134, p. 1, of later amended), - Council Regulation (EU) 2022/263 of February 23, 2022 on restrictive measures in response to the recognition of government-controlled areas of the Ukrainian Donetsk and Luhansk oblasts and ordering the deployment of Russian armed forces in these areas (Official Journal of the EU.L. 2022.42I, p. 77, as amended) and - Council Regulation (EU) No. 692/2014 of 23 June 2014 on restrictive measures in response to the illegal annexation of Crimea and Sevastopol (OJ L No. 183, p. 9, as amended) , by joining the procurement procedure and submitting an offer in response to this inquiry, the bidder guarantees that Rafineria Gdańska Sp. z o. o. as a result of the implementation of the submitted offer, will not come from or be exported from Russia or Belarus or the Luhansk or Donetsk oblasts or Crimea or Sevastopol (territories of Ukraine). Please also, under the pain of nullity of the submitted offer, enclose in the substantive part the signed statement from Annexes 1 and 2. III. Substantive questions and offer Any substantive questions regarding the technical specification should be asked via the Logintrade purchasing platform. Contact outside the designated path may result in the exclusion of the supplier from this contractor selection procedure. The Bidder submits an offer only through the Logintrade Purchasing Platform. Along with the offer, it is absolutely required to confirm the requirements set out in the content of the request for proposals and clearly indicate any deviations from the requirements, if any. The offer should be prepared in Polish or English. IV. Form and content of the offer: The basis for preparing the offer is the technical specification of the material included in the request for quotation and Technical Standards available at: Technical Standards - Grupa LOTOS S.A The technical part must include: - Technical information required in the inquiry, excluding the price, taking into account: - attaching technical requirements for the product, - completion date from the moment the demand is called - statement regarding the fulfillment of selected requirements of the REACH regulation - if applicable - the CN code. The commercial part must include: a. Unit price b. Terms of delivery - DDP/DAP Rafineria Gdańska Sp. z o. o. Gdansk, Poland, c. Delivery Date d. Offer validity period - minimum 60 days e. Warranty period - at least 24 months, unless the manufacturer offers otherwise f. Payment terms - if other than those required in the procedure g. Signed attachment no. 1 - Bidder's declaration h. Signed Appendix No. 2 - Sanctions Statement Attention: – The Bidder declares that the offered products are new, without defects or damage, and that the delivery date will not result in the expiry date/warranty and their use will not be possible. - The Ordering Party reserves the right to accept the offer in whole or in part - Substitutes from other manufacturers are not allowed Failure to meet the above requirements may be the basis for rejection of the offer. V. Rafineria Gdańska Sp. z o. o. is entitled to verify the financial credibility of the contractor applying in the procedure for the selection of the contractor based on financial documents made available in the relevant register (e.g. financial statements). Verification of the financial situation of the tenderer will be carried out, among others, by: based on the bidder's income shown in the financial statements available in the relevant register for the years preceding the verification (no more than 3 years). VI. Rafineria Gdańska Sp. z o. o. reserves the right to cancel the contractor selection process, to close the process without selecting a contractor, and to negotiate with the selected bidder or bidders until the contract is signed/order is issued. The selection of the bidder(s) for further negotiations does not constitute acceptance of the offer or settlement of the tender within the meaning of the Civil Code. In such a case, Bidders are not entitled to any financial claims against the Ordering Party. VII. The Ordering Party will reject offers containing an abnormally low price, in accordance with the information attached to the Request for Proposals. VIII. All information presented in this document is intended solely for the purpose of preparing the Offer and under no circumstances should it be used in a different way and for other purposes. IX.
